COURSE BOOKING TERMS AND CONDITIONS


 

This information should be read carefully before booking any course or activity with Polaris Wilderness Adventure Ltd, or purchasing goods from our shop.

Upon completion, submission and acceptance of the booking form the clients/participants named on the booking form will have entered into a binding contract on the basis of the following terms and conditions (click for PDF version).

1. AGREEMENT

The person making the booking is classed as the “lead name” in any booking which includes more than one person. Where you are the lead name you guarantee to us that you have the authority to accept (and do accept) these Terms and Conditions (and our Policies) for each person in your party and that you have drawn these Terms and Conditions to their attention. You will be the primary contact with us and will accept any communications/correspondence from us on behalf of your entire party. You must be over 18 to make a booking.

Any agreement based on the outline terms and conditions arises upon the fulfilment of the following:

 

(a) Receipt and clearance in Polaris Wilderness Adventure Ltd.’s Bank Account of full payment or deposit in section 2 below, a fully completed hard-copy booking form received by Polaris, or receipt by email of an online booking form booked through Polarisbushcraft.co.uk website; a fully completed Emergency Contact and Health Declaration form and acceptance of this by Polaris Wilderness Adventure.

 

(b) That the signature on the booking form or the person named on the online booking form is taken as the client attending the course or by a legally recognised agent of the client for and on their behalf. The agreement is governed by English Law. The email received by Polarisvia the online booking form may be taken as evidence of this agreement.

 

(c) The agreement is between Polaris Wilderness Adventure and the client(s) on the booking form or online booking form and is the sole agreement between those parties.

 

(d) Polaris Wilderness Adventure reserves the right to refuse bookings to any party or individual without the need to give reasons solely at Polaris Wilderness Adventure Ltd’s discretion and we will return any payment accompanying the booking form or refund any payment is made online.

 

(e) No variation of these terms & conditions shall be applicable unless agreed in writing by Polaris Wilderness Adventure before the relevant

course.

 

1a. Age conditions

The client must be must be 18 years old or over to make a booking.

Persons attending a Polaris Wilderness Adventure course under 16 years old must be accompanied by a person over 18 on any Polaris Wilderness Adventure course.

Children must be 6 years old or over to attend any Polaris Wilderness Adventure course especially for overnight courses and must be accompanied as the preceding paragraph.

 

Exceptions to these ages may be made; but only after contact with and with the express consent of Polaris Wilderness Adventure. Any Polaris Wilderness Adventure Staff member, Instructor/Guide or Assistant has the right to refuse entry onto the site if he or she suspects that a person is breaking any age condition.

 

Adults are responsible for the behaviour of children at all times. This is a safety pre-requisite. Any Polaris Wilderness Adventure Guide, Instructor or Assistant may request that behaviour be moderated (see section 10, Client conduct).

 

2. DESCRIPTION AND PRICE OF GOODS AND COURSES

All descriptions and prices for items are correct and applicable at the point of sale. Polaris Wilderness Adventure Ltd retains the right to change descriptions and prices as required and without notice.

 

All photographs and descriptions of items are designed to show a true representation of the good or course. They however do not form part of the contract between Polaris Wilderness Adventure Ltd and the client.

 

All goods and courses are sold subject to availability. Any goods and courses sold that are not available will entitle the client to a full refund within 14 working days, (although we would aspire to refund you immediately subject to security checks).

Polaris Wilderness Adventure Ltd accepts no responsibility for loss, damage or injury resulting from the use of any good sold from this website. Knowledge of and adherence to local laws and or statutes is the responsibility of the client.

 

There is no contract between Polaris Wilderness Adventure Ltd and the client until Polaris Wilderness Adventure Ltd has received your order and you have received a confirmation email back to the address you provide.

Polaris Wilderness Adventure Ltd reserves the right to refuse to accept orders from individuals or companies without further explanation.

Polaris Wilderness Adventure Ltd, its employees and other agents shall not be liable for any direct, indirect, special or consequential loss or damage including loss of profit or any other form of compensation.

Whilst every effort is made to limit prices to those given on the website or marketing material, Polaris Wilderness Adventure reserves the right to alter prices should its costs in hosting a course increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport and materials).

 

In the event that a price is altered the client(s) will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as was the original price.

In the event of the price being thus increased by 15% or more the client may opt to cancel the booking and will then be entitled to a refund of all monies paid.

Polaris reserves the right to change these terms of sale without notice to you in relation to future sales, all changes will be made available for clients and potential clients to see on this website under the terms and conditions section.

 

3. DELIVERY

Items are normally despatched within 48 hours Monday to Friday by first class mail. All items ordered will be posted to the address requested at the time of order, and cannot be changed afterwards to a different address

 

4. RETURNS

If there is any problem with your goods that relate to a manufacturing fault Polaris Wilderness Adventure Ltd will replace the damaged or defective items. If no replacements are available Polaris Wilderness Adventure Ltd will be pleased to offer a refund. (Please refer to course terms and conditions below for course complaints information). This does not affect your statutory rights.

 

If for any reason you are unhappy with your purchase Polaris Wilderness Adventure Ltd will fully refund the purchase value of any item within 7 days of receipt of the order, this includes gift voucher. Items must be returned unused, free from damage, and be contained within its original packaging. We would recommend taking insurance when returning goods as Polaris Wilderness Adventure Ltd cannot be held responsible for goods damaged in transit.

 

5. COURSE BOOKINGS

Please note these course terms and conditions are in addition to the terms and conditions outlined above. The course terms and conditions continue to form the basis of the contract between Polaris Wilderness Adventure Ltd and the client.

Course participants must be over 18 years of age or accompanied by an adult and agreed with Polaris Wilderness Adventure Ltd. Course participants must have a good standard of general fitness. Polaris Wilderness Adventure Ltd . cannot be held responsible for any losses incurred as a result of failure of clients to disclose medical conditions.

 

6. PAYMENT

Where an online booking has been made, if no payment (deposit or full payment) has been received within 7 days of receipt of the on-line booking form, Polaris Wilderness Adventure reserves the right to treat the agreement as cancelled by the client(s) without notification to the client(s).

A deposit (normally £25-00) will secure a place on a Polaris Wilderness Adventure course subject to availability and these Terms and Conditions.

 

7. GIFT VOUCHERS

Occasionally, Polaris Wilderness Adventure will offer special offers and Gift Vouchers. The Gift Vouchers are available to purchase on payment of a deposit. The gift voucher will be sent to the purchaser if requested, or a voucher code may be emailed. The gift voucher will not be valid unless:

 

(a) the voucher has been signed and dated by Polaris Wilderness Adventure;

 

(b) a payment of the balance for a course or event has been received in full and;

 

(c) a booking form has been received from the person to whom the voucher is made out. 

 

The voucher is valid only for the course or event stated unless special arrangement has been made with Polaris Wilderness Adventure and valid only until the date stated. The voucher is not transferable.

Gift vouchers are non transferable. Over the 7 day return period above gift vouchers are non refundable.

 

8. COURSE DATE CHANGES

Should a customer wish to change the dates of their course, where there is a place available, an administration fee of £25.00 will be charged to transfer. Please note Polaris will not be able to transfer a booking if the course is due to start in less than 9 weeks.

 

9. VARIATION OF COURSES BY POLARIS WILDERNESS ADVENTURE

A Polaris Wilderness Adventure course or session is, by its very nature, subject to natural variables and whilst every reasonable effort is made to comply with course content, Polaris Wilderness Adventure reserves the right to vary or modify a course itinerary at short notice in order to take advantage of naturally prevailing conditions. The client acknowledges that information about courses or sessions provided by Polaris Wilderness Adventure is given to the best of our ability but because of the variability of nature it may be reasonable to alter or modify a course and that in such circumstances it is not reasonable for Polaris Wilderness Adventure to be liable for any losses consequential on such a change and that Polaris Wilderness Adventure or liability is limited accordingly.

 

10. CANCELLATION OF COURSE BY POLARIS WILDERNESS ADVENTURE

In the event that Polaris Wilderness Adventure cancels a course, all monies will be refunded in full, or if preferred, transferred as a deposit for another course. Please note that Polaris Wilderness Adventure may require a minimum number of clients to run a course. Polaris Wilderness Adventure reserves the right to cancel all and any bookings without reason or notice. Under these unlikely circumstances Polaris Wilderness Adventure agrees to repay in full all and any deposits of course fees to the client.

 

11. CANCELLATION BY CLIENT

In the event that the client wishes to cancel a course booking (including reasons of illness, unforeseen circumstances etc), fees will be refunded as follows

i)Only cancellations with 12 full weeks notice provided by the client will be refunded in full.

ii) Client giving between 12 and  9 full weeks notice of cancellation prior to course start date, Polaris Wilderness Adventure Ltd will refund 50% of total fees paid

iii) Client gives less than 9 weeks notice of cancellation prior to course start date, total course fees are 100% non-refundable.

iv) Bookings can be transferred into different names subject to a £25 administration fee.

v) The client has the option to change the date of their course, see section 8 Course date changes.

 

12. CLIENT CONDUCT

Polaris Wilderness Adventure clients are expected to behave in a reasonable manner at all times and to comply with the instructions and leadership of Polaris Instructors and staff, save that parents, teachers and those in comparable roles in respect of children must maintain control of those children, to the satisfaction of Polaris Wilderness Adventure. Polaris Wilderness Adventure reserves the right to remove any client(s) from the course or session at the discretion of the lead guide or instructor without recourse to repayment for that course and against the client(s) will if necessary.

Circumstances that may warrant exclusion from a course include (without limitation): intoxication, use of recreational drugs, abusive or inappropriate behaviour, inappropriate or unsafe use of equipment, inability to meet the rigours of the course for physical or mental reasons, or through lack of appropriate equipment. If you are in any doubt about your ability to meet the rigours of the course, please contact your GP before booking. For removal of any party under such conditions, Polaris Wilderness Adventure will not be liable for any losses as a result and Polaris Wilderness Adventure is also entitled to any reasonable costs arising from removal of said client(s) payable upon demand.

 

1. Clients are required to behave in a safe and reasonable manner throughout the course, and not to jeopardise the enjoyment or the safety of other course participants. In particular:

 

2. No alcohol or illegal drugs are permitted, and clients must not be intoxicated at any time during the course.

 

3. Clients are responsible for bringing adequate clothing and equipment to the course, as per the Kit List, which will be sent to all clients prior to the course.

 

4. Clients must comply with all reasonable instructions and directions from the Instructors, and in particular no knives must be used until the Instructors are satisfied that the clients have been fully instructed in knife safety.

 

5. No fires are to be lit without the express consent of the Instructors, and fires must not be left unattended at any time.

 

6. Clients are requested to respect and to follow Polaris Wilderness Adventures Environmental Policy.

 

7. Clients are responsible for any equipment issued to them during the course, and will be liable for loss or breakage. All equipment must be handed back in the same condition it was issued in.

 

Failure to comply with the above may result in removal from the course, without refund, and Polaris Wilderness Adventure Ltd. will not be liable for any subsequent losses.

 

13. INSURANCE

Polaris Wilderness Adventure Ltd is covered to a level of £5,000,000 for public liability and is insured as an outdoor activity provider. Polaris Wilderness Adventure clients are advised to provide their own personal insurance cover. Please take note of conditions in your policy with regard to “hazardous activities” and “working with hand tools”.

 

14. LIABILITY

Polaris Wilderness Adventure courses take place in the outdoors, which by its nature is never free from hazard. While all reasonable precautions are taken to minimise the risk the client accepts that accidents including serious injury and death can occur without Polaris Wilderness Adventure being at fault and to that extent he/she is taking part in a Polaris Wilderness Adventure course at his/her own risk. The client also recognises that Polaris Wilderness Adventure is not responsible for loss or damage to the personal property of the client, including vehicles, money, clothing and or equipment.

The client also recognises attendance of a Polaris Wilderness Adventure course in no way qualifies him/her to teach the course content. It is not intended that any instructions provided to any client(s) while on a course will in any way qualify those client(s) to instruct any third party & no warranty is made to that effect. Polaris Wilderness Adventure hereby excludes any liability it might have to any third party in respect of any loss or damage suffered or incurred by that third party in its reliance on any skills taught by any client(s) on the basis of having attended any Polaris Wilderness Adventure courses or sessions.

Polaris Wilderness Adventure accepts no responsibility for any mishap during a course from any instruction or information not given by Polaris Wilderness Adventure appointed guides, instructors or assistants. Polaris Wilderness Adventure also takes no responsibility for any mishaps occurring as a result of the client’s failure to follow instructions. Polaris Wilderness Adventure will only accept liability for physical injury to a client that is shown to result from negligence on the part of Polaris. 

 

15. COMPLAINTS  

In the unlikely event that a client has cause for complaint about a Polaris Wilderness Adventure course, the complaint should be made to a representative of Polaris Wilderness Adventure during the event in order that corrective action can be taken if necessary. The client acknowledges that it is unreasonable not to raise an issue during a course but to complain later. If the complaint is about a member of staff then please contact the office and we shall inform you of the complaints procedure and take the necessary action. Any complaint must be made immediately. Polaris Wilderness Adventure will not accept a complaint after the end of the course. However should the problem not be resolved satisfactorily, a complaint should be made in writing within 28 days or this complaint will not be upheld.

 

16. TRAVEL DOCUMENTS

The client is solely responsible, where necessary, for ensuring that he / she has all necessary valid travel documents.

 

17. CONSENT FORM

The client acknowledges that they must sign and complete a Consent Form, which must be returned to Polaris at least Two weeks prior to the commencement of the customer’s course. The Consent Form will be emailed to the customer when they make final payment for their workshop. The client will be reminded to complete and return the form when they have paid their remaining course payment.

 

18. AUCTION WEBSITE LISTINGS (WORKSHOP RESALES)

Polaris Wilderness Adventure Ltd does not permit the resale of its workshops and courses on auction websites, such as eBay. Polaris Wilderness Adventure Ltd has customer waiting lists and cancellation lists in place, and the resale of such workshop places interferes with this process.

 

19. AUCTION WEBSITE LISTINGS (KIT ITEMS)

Kit items purchased from Polaris Wilderness Adventure Ltd may be resold on auction websites such as eBay. Please ensure that all trademarks are respected

 

20. OTHER

The Client agrees that any photographs taken by Polaris Staff during the course may be used by Polaris Wilderness Adventure Ltd. in promotional material, either printed or on the Internet.
